Express Entry Program

The Express Entry Program was introduced in January 2015 and is a two-stage process to obtaining Canadian Permanent Residence. The Express Entry Program is a points-based system and individuals must qualify under one of the four selected streams to be eligible for this program. Points are awarded based on set factors, and individuals who are eligible for this program are entered into a pool of candidates.

Throughout the year, draws take place and individuals from the pool that are above the minimum threshold for that draw are provided with an Invitation to Apply (ITA) for Permanent Residence. Individuals who receive an ITA must submit their application to Immigration, Refugees, and Citizenship Canada within a 60-day period.

Provincial Programs and Express Entry Program

There are also many provinces who consider individuals, after they have entered themselves into the pool of candidates, for nomination. This route also allows individuals to obtain their final goal of Canadian Permanent Residence.

Provincial Nominee Programs

Canada’s provinces and territories provide individuals with an opportunity to obtain permanent residence through each of their numerous nomination programs. Across the country, there are over 50 available programs, each different and unique in its set of requirements. Most of these programs have annual quotas and close once they have been filled.

Spousal/Common-Law Partner/ Conjugal Partner Sponsorship Program

Canadian Permanent Residents and Citizens may be eligible to sponsor their spouse, common-law or conjugal partner to Canada on a permanent basis. An application can be made from within Canada (in-land) or from outside of Canada, depending on the type of application being submitted. Foreign nationals, who are being sponsored and who want to remain in Canada, may also be eligible for an open work permit.

Parent and Grandparent Sponsorship Program

As of January 2019, the process to sponsor parents and grandparents to Canada has changed. Individuals interested in sponsoring their parents or grandparents must complete an online Interest to Sponsor form as soon as the program opens, which is expected in late January 2019. Immigration, Refugees and Citizenship Canada will then provide invitations to sponsors to submit complete applications, based on a first-come first-serve basis, until their increased quota of 20,000 applications has been reached.

Humanitarian and Compassionate Grounds

In many situations individuals are not eligible for Permanent Residence under an identified program by Immigration, Refugees and Citizenship Canada, and therefore may be eligible to apply on humanitarian and compassionate grounds. Humanitarian and compassionate grounds applications are assessed on a case-by-case basis and must be supported by certain factors. This type of application also has strict rules which may bar individuals from applying, for a certain duration of time, on these grounds.

Permanent Resident Card Renewal

Individuals must meet certain conditions, one of which is the residency obligation to renew their Permanent Resident Card. If an individual does not meet their residency obligation there are exceptions under which they can still apply for and receive a renewed Permanent Resident Card.
